'Bail Is Rule, Jail Is Exception': SC On Manish Sisodia Bail Order

Delhi Excise Policy Case: The Supreme Court granted bail to AAP leader Manish Sisodia on Friday, emphasizing that the trial process, involving 493 witnesses and over a lakh pages of documents, could take a considerable amount of time. The court noted that keeping Sisodia in jail for such an extended period without a trial conclusion would violate his fundamental rights. The bench highlighted that trial courts and High Courts must recognize that "bail is the rule, and jail is the exception."

Concerns Over Prolonged Incarceration

Sisodia's prolonged incarceration without a speedy trial was a central concern for the Supreme Court. The court remarked that denying bail effectively punishes the accused without a verdict, which should not happen. The justices also pointed out that Sisodia, who has deep roots in society, poses no flight risk, reinforcing the decision to grant bail.

Conditions Imposed On Bail

The court imposed strict conditions on Sisodia, including a bail bond of Rs 10 lakh, surrendering his passport, and regular check-ins with the investigating officer. Sisodia was also cautioned against influencing witnesses or tampering with evidence.

The court criticized the lower courts for ignoring the well-established principle that bail should not be withheld as a form of punishment.
